ENTERTAINMENT AGREEMENT

THE PARTIES: This Agreement is for the mobile disc jockey entertainment services for the event described below, between the undersigned Client and The Party Shakers.

PAYMENT TERMS: Total fee agreed upon by Client and The Party Shakers is $000. The Party Shakers are holding a tentative reservation for the Client's event until the above "Response Date." To confirm this Agreement, return one signed and completed copy along with a deposit of $000 or the total amount due BEFORE THE ABOVE RESPONSE DATE. Agreements received after the Response Date are subject to availability. If sending a deposit, the balance will be due no later than the date of the event unless otherwise previously arranged and may be made by check, money order or cash. All checks should be made payable to MARK DAVIS. There will be a $30 fee charged for all returned checks. Gratuities given to a Disc Jockey at an event are made at the sole discretion of the Client.

CANCELLATION: This Agreement cannot be canceled or modified except in writing by either the Client or The Party Shakers. If the Client initiates cancellation less than 60 days prior to the event, then the deposit will be forfeited. For cancellation less than 30 days prior to the event, Client is responsible for the total fee or may forfeit the deposit only by signing a new Entertainment Agreement with The Party Shakers within 2 weeks of cancellation for a substitute engagement performed in the following 6 months. Rescheduling for events canceled due to inclement weather shall be accommodated whenever possible. Rescheduled events are subject to availability.

OVERTIME: When feasible, Client request for extended playing time during an event will be accommodated. Overtime requested may be made in one hour increments at a cost of $75 per hour. Payment for overtime is due on the date of the event, and may be made using the payment methods mentioned above.

PROVISIONS: The Client shall ensure that: (1) performance facility provide a performance area within 25 feet of a 110-volt outlet (3 prong grounded); (2) facility is open at least one hour prior to the scheduled start time; (3) reasonable steps will be taken to protect The Party Shakers' equipment, personnel and music. Crowd control will be provided if necessary; (5) for outdoor performances, shelter is provided that completely covers and protects The Party Shakers' equipment from adverse weather conditions which is to include direct sunlight.

Client accepts full responsibility and is liable for any damages, injuries or delays that occur as a result of failure to comply with these provisions. In the event circumstances deemed by the DJ to present a real or implied threat of injury or harm to the DJ, equipment or music, then the DJ reserves the right to cease performance until such time as Client resolves the threatening situation. The DJ further reserves the rights to deny any guest access to the music or equipment. In the unlikely event the DJ's performance is delayed, liability is limited to providing Client with performance time equal to time lacking.

ALL CHECKS OR MONEY ORDERS MUST BE MADE OUT TO MARK DAVIS.
